Gani Fawehinmi died on the 5th of September, 2009 aged 71.
Even in death, Gani Fawehinmi remains a very organized person. In his will, the legal luminary made sure his 2 wives, a mistress, 15 kids and 4 sisters were catered for. The Will was dated 19th of December 2008.
He permit his younger wife to remarry if she so desires. The will stated that Mohammed who was crippled in a motor accident stay on top and in charge of running his estate with 11 staff of his on monthly allowance of 10,000 and 15,000 naira. Scholarship would also be awarded to 10 indigent students yearly.
The reason late Gani Fawehinmi was not buried completely following the Islam doctrine was because his will mentioned that ‘opportunity has been given to as many people as possible to view my corpse lying in state inmy house at Oka road Ondo.’
He saved, provided and opened a bank account with First Bank of Nigeria PLC ‘in which reasonable fund is being kept to meet my funeral expenses’ with Mojeed Ajao, Mohammed Fawehinmi [his eldest son], Basirat Biobaku and Rabiat Fawehinmi granted access to make withdrawals from the account. His wife and children were bequeathed the houses and landed property in GRA, Ikeja Lagos with instructions that they were not sold in the lifetime of his wife and eldest son. His eldest son who uses a wheelchair has rights to live in any part of the house besides the bungalow at the back of the house built for Gani’s late mother and the bungalow should be used reserved for use by his sisters whenever they visit Lagos and one his sisters, Rufukatu Fashipe should be the bearer of the keys to the bungalow. None of his sisters can sell or let the bungalow and when they pass on, the building should be reverted to the children of his first wife. A house in Surulere, property and three bungalows in Akure were bequeathed to his second wife and children and if the property is ever sold.The first child for his second wife, Rabiat Fawehinmi should be entitled to 20% of all proceeds. The 80% should be used for repairs of his house in Surulere and partly shared by the other children and their mom not exempting Rabiat.
A trust account, Gani Fawehinmi Trust account should be opened by his appointed trustee, First Trustees Nigeria Limited, a subsidiary of FBN, PLC. His property at Ondo measuring 7.801 hectares should be sold as well as his flat in England with the building of his chamber reovated and leased out two years after his death and money realized should be deposited into the Trust Fund bank account.
He also ensured that Nigeria Law Publications Limited does not die by appointing and asking that the current managing director can remain in his present appointment until he is 60 years of age and several other measures. Late Gani also directed his trustee to provide Nigerian Bar association the sum of 1 million naira monthly to organize the ‘FAWEHINMIISM’ symposium.
He gave his first son his two cars and the daughter from his second wife got his Toyota crown which she would use on the day of her marriage.
He ended the will thus: ‘I have had enough of painful struggles and controversies in my life time, I should be allowed to rest in peace.
If any child or wife breaches this passionate plea, he or she will reap my displeasure and wrath.
Generally any of my children or wives can have access to my grave site to pray and/or seek spiritual assistance.’.
